Hulu Ad Machinations; Listings Or Bust For Yext

huluHere?s today?s AdExchanger.com news round-up? Want it by email? Sign-up here.

Hulu Ads, Direction

Big changes are coming to Hulu, and they?re all starting at the top, beginning with the position of CEO Jason Kilar and the relationship to the streaming video site?s big media backers, reports Variety?s Andrew Wallenstein. Citing a three-page memo about Hulu?s business model that was dated in July, the document discusses whether or not Kilar will stay on after a big payday. Also, News Corp., which owns Fox Broadcasting, wants wants to see four ads per commercial pod on Hulu.com (instead of just one), and that?s just for starters.

Yahoo Exec Shakeout

Ad Age?s Jason Del Rey reports that Yahoo! CRO (and former Admeld CEO) Michael Barrett is staying put even though other Yahoo! executives continue to depart in the wake of the hiring of new Yahoo! CEO Marissa Mayer. Del Rey writes, ?Earlier today, Yahoo said in a statement that Mr. Barrett would be leading the North American sales staff on an interim basis following news that Wayne Powers, Yahoo?s senior-VP of North American ad sales, was leaving to become president and group publisher at Parade Publications.? Read more. Yahoo!?s Barrett will be presenting at AdExchanger?s Human Centered Automation Conference on September 20.

Video Ads? Emotional Missing Link

MediaMind?s Boaz Ram writes in iMedia Connection that there?s a world of difference between the kind of pricing that?s commanded by TV and by most online video. It starts with the fact TV targets themes and online targets behaviors, ?The Office viewers are there to laugh or cringe themselves to tears. NBA playoffs watchers are there to be exhilarated. Mad Men fans are immersed in a world that wears high heels and sips bourbon before 10 a.m? The demographic for all these shows may be right-on for a running shoe maker, but the emotional vibe? Might as well be three different planets.? Read more.

Facebook?s Ad Pitch (Circa ?04)

Facebook advertising has a long history that shows the company thinking carefully about its approach to brands and media buyers way before its IPO and the introduction of the Facebook Exchange marketplace. Digiday?s Jack Marshall has found something of a Facebook artifact, a pitch deck from 2004, when the social network had a ?the? attached to its name. See it now.

Cashing Pay Per Call

It?s local listings plumbing or bust for Yext as the company announced the sale of its pay-per-call business to IAC for a rumored $30 million. ?Read more in Digital Media Wire. ?In an interview with Bloomberg?s Dierdre Bolton, CEO Howard Lerman confirmed the ?ballpark? sales price and said that Felix (the pay-per-call biz) had represented 90% of Yext revenue last year. ?Now, it?s all listings. ?See it. ?And, read this May 2011 AdExchanger interview with Lerman when he discussed the listings business origins.

Challenging DNT

In a sharp rebuke of Microsoft?s application of Do-Not-Track in its new Internet Explorer browser, Bizo CEO Russ Glass lays out his case on the Bizo blog. Glass sees harm for the consumer: ?DNT is a blunt instrument that doesn?t allow you or me to have choice over which of our preferred vendors are able to serve us offers we might actually find valuable. ?For example, if you were a frequent visitor to Amazon and they had a 50% deal on a product you loved, if DNT was turned on, you wouldn?t receive that offer as you surfed the web. ?That?s a bummer for everyone who wants privacy but also values a good experience online.? ?Read more.

Education Frontier

As web users get more and more used to free content ? and traditional media continues to see profits and paying audiences shrink ? there appears to be one digital area that people may be willing to pay for: education. Or, more specifically, something called ?Techbooks,? which the NYT?s Brooks Barnes and Amy Chozick describe as digital manuals that include video, virtual labs, downloadable content. As novel as that sounds, even more interesting is the company?s newest backer: cable network giant Discovery Communications. ?Educational content is core to our DNA, and we?re unencumbered ? unlike traditional textbook publishers, we?re not defending a dying business,? said Discovery CEO David Zaslav. Read more.

But Wait. There?s More!

Romney renews Obama welfare criticism in new ad

(AP) ? Republican Mitt Romney is renewing his criticism of President Barack Obama's welfare policy, accusing him in a new ad of "gutting welfare reform." The ad says Romney would "put work back in welfare."

Romney says Obama lifted a provision that required people receiving welfare to work. Independent fact checkers have found the premise of the ad to be false.

Last month, Obama moved to allow states to seek waivers from some welfare rules. To get a waiver, states must show their plans would move at least 20 percent more people to work.

Conservatives say waivers will lead to an end of the work requirement. Romney was among several Republican governors who signed a letter in 2005 asking for more flexibility.

The Romney campaign did not say in which states the ad would run. The campaign says Romney will press the welfare issue during a town hall in New Hampshire Monday.

Biggest and best Boeing arrives in Africa

Austin News.Net Saturday 18th August, 2012

Ethiopia has received a Boeing 787 Dreamliner.

It is only the second country after Japan to take delivery of the Boeing 787 Dreamliner.

The country's airline, Ethiopian Airlines, will now be the first company in Africa to receive the aircraft.

Addis Ababa's Bole International Airport was packed for the touchdown in a proud moment for the company's workers, many of whom surrounded the plane to take photos.

Ethiopian Airlines has bought 10 of the Boeing flagship aircraft, which are built from lightweight material, rather than aluminium, to save fuel.

Each Dreamliner costs around $200 million.

(AP Photo/Sue Ogrocki)

NEW YORK (AP) ? Six months after J.C. Penney Co. launched a bold new pricing plan, customers still aren't buying it.

The midprice department store chain reported a bigger-than-expected loss and plummeting sales during the second quarter, as its customers remain confused by the new pricing strategy that ditched hundreds of sales in favor of everyday lower prices. The bleak performance marks the second straight quarter of steep sales declines since the plan was introduced Feb. 1.

The company also withdrew its profit guidance for the year. Its shares tumbled more than 8 percent in premarket trading.

Penney's poor results, released Friday, underscore how difficult it is for a company to change the way shoppers behave. In a still-struggling economy, shoppers are still looking for racks of "70 percent off" sales signs and coupons. The latest financial performance also tests the patience of investors and adds more pressure on its new CEO, former Apple Inc. executive Ron Johnson, to turn things around at the retailer.

Under Johnson, Penney is transforming everything from the items it stocks to store design. But the riskiest move has been its pricing, which is turning out to be an even tougher sale to shoppers than previously expected. The latest results cast more doubt it will work at all.

"This is worse on top of whatever I thought was going to be a bad story," said Brian Sozzi, chief equities analyst for research firm NBG Productions. "I am losing faith" in the pricing switch.

Johnson, however, promised to stay the course.

"'We have now completed the first six months of our transformation, and while business continues to be softer than anticipated, we are confident the transformation is on track," said Johnson in a statement." The transition from a highly promotional business model to one based on everyday value will take time and we will stay the course."

In May, Penney's stock plunged 20 percent, its biggest one-day decline in four decades, after the retailer posted a larger-than expected first-quarter loss and a 20.1 percent drop in revenue because of the poor reception from shoppers.

Things got even worse in the second quarter as Penney scrambled to backpedal and shift its marketing strategy to get shoppers back in the store.

The department store, based in Plano, Texas, said Friday that it lost $147 million, or 67 cents per share, in the quarter ended July 28. That compares with net income of $14 million, or 7 cents per share, a year ago.

Revenue tumbled almost 23 percent to $3.02 billion. Revenue at stores open at least a year fell 21.7 percent, worse than the 18.9 percent drop the quarter before.

Excluding one-time items, Penney's loss was 37 cents per share. Analysts had expected a 26-cent loss on revenue of $3.2 billion.

The company said that its gross profit margins fell to 33.2 percent in the quarter, down from 38.3 percent a year ago.

Johnson described the balance sheet as "rock solid." The company said it ended the quarter with about $888 million in cash and cash equivalents.

Its shares tumbled $1.87, or 8.5 percent, to $20.23 in premarket trading. The stock is down more than 50 percent since investors, initially enthusiastic, bid them up to about $43 after Johnson announced the pricing plan in January.

Penney on Feb. 1 began using three-tier pricing with consistently lower daily prices that were 40 percent below last year, deeper monthlong sales on specific items and periodic discounts that are even more generous throughout the year. But Aug. 1, Penney eliminated the monthly sales events and increased the frequency of the periodic sales to every Friday. These had been called "Best Price" sales but are now being called "clearance."

Penney is keeping "Every Day" low prices, which has accounted for about 70 percent of sales since the company began the new strategy.

Johnson had said the new approach should make pricing easier for customers to understand.

"We thought, 'Why are we trying to teach customers new language to shop?" Johnson said in a recent interview with The Associated Press. "We're just trying to be straightforward."

Penney is tweaking its advertising to better explain the change. That includes inserts in newspapers every Friday during the back-to-school season highlighting specific products like jeans. TV ads tout free children's haircuts at stores to draw shoppers.

The new ads are in stark contrast to the spots that introduced the new pricing plan. The "fair and square" brand campaign featured commercials with dogs, kids and bright colors ? but little explanation of prices.

Some analysts hope Penney will attract more shoppers once it makes the stores more inviting. Starting this fall, almost half its merchandise will be new. It plans to some brands and redesigning others. Among the new brands shoppers will see are Vivienne Tam and Betsey Johnson, who will be selling affordable versions to Penney.

Penney just launched shops for Levi's and its own jeans brand Arizona. It plans 100 shops within each of its stores by 2015 that will either focus on one brand or a variety of labels. The company also plans to add areas in its stores called Town Squares to offer services and advice.

Even that plan has had its hiccups. Last month, Macy's won a preliminary court ruling against Martha Stewart Living that would prevent it from selling some of its products like cookware and kitchen utensils at J.C. Penney. Penney has been counting on the popularity of the Martha Stewart brand to revitalize its business.

Penney said Friday that it no longer expects to meet its earnings guidance for 2012. It had expected a profit of $2.16 per share. Analysts expected the company to earn $1.26 per share for the year.

(AP) ? The names change, not the results. Just call the U.S. women's basketball team Olympic champion ? again.

The Americans won their fifth straight gold medal Saturday, routing France 86-50 and putting more distance between themselves and the rest of the world heading into the 2016 Rio Games.

"It just shows the depth and talent in our country. Women's basketball, it's our sport ? it's our sport," said Diana Taurasi, who has been a part of the last three gold medals. "We grew up playing since we were little and give it every single little bit of energy we have."

Candace Parker scored 21 points, including eight straight during the game-changing run in the second quarter as the U.S. won its 41st straight Olympic game.

This one was special.

Taurasi, who said she doesn't get emotional, cried receiving her gold medal and then paraded around draped in an American flag.

"A little trip down memory lane," Taurasi said. "The track record was going through my head. My parents, Coach was there. It was just a lot of things hit me at once and that's what happened."

The winning streak started in the bronze medal game in 1992. In that stretch, the Americans have won by nearly 30 points a game. Only one team has stayed within single digits of them, and they've lost just once in major international competitions, to Russia in the semifinals of the 2006 world championship.

Coach Geno Auriemma didn't want to get drawn into the debate of where this team ranks among the five that have won the gold.

"The United States has had great teams since 1996 and we are just another one on the list," he said. "We accomplished the same thing they did and I don't know if that separates us. I think it just makes us equal."

Teresa Edwards, Dawn Staley, Sheryl Swoopes and Lisa Leslie got the amazing run started, and Taurasi, Sue Bird and Tamika Catchings have continued it.

With young stars Parker, Maya Moore and Tina Charles a big part of the success in London it doesn't look like the run will end anytime soon.

"The players give back. You have players coming back for a third Olympics to show the younger players what it takes to win a gold medal," said Parker, a two-time Olympian. "I learned a lot from Tina Thompson, Lisa Leslie, Katie Smith and now Dee, Tamika, Sue. It's just the passing down of what it takes to win. That commitment to USA Basketball."

Catchings said the Americans "just wanted to keep that legacy going."

Edwards, a five-time Olympian, said no worry there.

"The legacy is real," said Edwards, who had a front-row seat Saturday night. "What these kids have been doing is amazing. Without much time to practice. In the middle of the WNBA season. And they look good. It's like the whole world knows who we are. I'm really proud of them.

"They're definitely among some of the best" U.S. teams.

The U.S. faced its only challenge of the London Games when Australia took a four-point halftime lead. It was the first time in 12 years that the Americans had been trailing at the half. There was no panic or worry. They just stepped up their defense and vanquished the Australians, winning by 13 points.

"It's not easy to just be put together and be expected to win a gold medal," Taurasi said. "It's a special feeling."

France, which came into the gold medal game unbeaten, stayed with the U.S. for the first 12 minutes before Parker took over. She scored eight straight points during a 13-2 run that gave the U.S. a 37-23 advantage. Twice the 6-foot-4 Parker grabbed the rebound on the defensive end and dribbled up through the defense scoring on the other.

While Parker ? who also had 11 rebounds ? was providing the offense, the Americans turned up their defense, holding France to just one basket over the final 7:25 of the half.

"We always felt like as long as we played our best ... we'd be all right," Bird said.

The U.S. led by 12 at the half and poured it on in the third quarter. France got within 41-31 but the U.S. scored 13 of the next 14 points any thoughts of a monumental upset were forgotten.

On one sequence, Catchings got a steal and passed to Bird, who hit Moore in perfect stride for a finger-roll lay-in down the lane. It only got worse from there for France, which was making its Olympic debut.

The Americans bottled up France's flashy point guard Celine Dumerc, who made only field goal in the first half and finished with eight points.

"I'm just happy to have this medal around my neck," Dumerc said of her silver. "We lost to a very good team and we made history for women's basketball in our country."

Apple reveals 2010 presentation to Samsung on Android patent infringement, licensing offer

As the battle between Samsung and Apple closed out another week in US District Court, lawyers for the latter focused its argument on evidence and testimony covering a presentation Apple made to Samsung in 2010, and its offer to license the patents. AllThingsD has the deck of slides from the meeting (embedded after the break), specifying areas and specific patents Apple believes Android as an OS infringes or things Samsung specifically copied elements from, plus a report on testimony from Apple executive Boris Teksler. He testified today about the meeting with Samsung, calling it a "trusted partner" (should be, since Apple paid it paid $5.7 billion for parts that year) that both Tim Cook and Steve Jobs spoke to directly about the issue.

While more information is expected from Teksler next week, he did have time to put a dollar amount on the licensing deal Apple subsequently offered, at about $30 per smartphone and $40 per tablet, as well as royalties also collected from phones running Symbian and Bada, with the possibility of a 20 percent discount if Samsung would cross license its own technology back to Apple. The companies are restricted by Judge Koh to 25 hours each to argue their points (Apple is at 11 and a half hours while Samsung has crossed over 12 with its own arguments yet to come) but we're sure there's enough time left for a few more revelations before any resolution is reached.

Billboard with dummy on noose shocks Vegas drivers

(AP Photo/KVVU, Peter Dawson)

(AP) ? Even by Las Vegas standards, it was a shocking billboard: A mannequin dangling on a hangman's noose below a black sign with the ominous words "Dying for Work."

Nevada Highway Patrol Trooper Jeremie Elliott says the 911 calls started coming in as the sun came up early Wednesday, with drivers worried the stiff, black-suited dummy swaying at the end of a rope along Interstate 15 near Bonanza Road was a real person.

"It's a publicity stunt, obviously done in bad taste," said Elliott, adding that officials were focused on getting it down quickly to avoid distracting drivers during the morning commute.

The graphic display along the interstate was one of at least two unauthorized signs spotted Wednesday morning in the Las Vegas area. Another found on Highland Avenue and Desert Inn Road was white with black lettering that read, "Hope You're Happy Wall St.," and a similar mannequin hanging off the edge.

A woman who answered the phone at Lamar Advertising Co., which owns one of the billboards, labeled the act vandalism and said the display was being removed. She did not provide her name.

Clear Channel Outdoor, which owns another sign that was affected, said they pulled the display immediately and plan to work with law enforcement to punish whoever is responsible.

"We condemn the destructive behavior against one of our billboards because it is illegal and punishes our advertisers," Clear Channel Outdoor spokesman Jim Cullinan said in a statement. "This is not an innocent protest, but it is illegal and dangerous behavior that Clear Channel Outdoor and the industry will not accept."

Although the billboard alarmed drivers, it's unclear whether regulations in the area ban roadside signs with graphic depictions of suicide. A spokesman for the Nevada Department of Transportation said there didn't appear to be state regulations on the matter, and a spokeswoman for Clark County was also not aware of rules against the subject matter.

While nobody has publicly claimed responsibility for the signs, the Occupy Las Vegas group, which is affiliated with the larger Occupy Wall Street movement, posted photos of the displays on its website. Its caption says the Nevada governor's budget has slashed social programs and aid to suicidal adults.

Sebring Frehner, an Occupy supporter who posted the photos, told The Associated Press he didn't know who put the hangmen up, but applauded the message behind it.

"People saying it's in bad taste are living sheltered lives and don't pay attention to what affects the working class," he said.

Syrian refugees near 150,000: U.N

GENEVA (Reuters) - Growing numbers of Syrian civilians are fleeing fighting, especially in Aleppo, bringing the total to nearly 150,000 refugees registered in four neighboring countries since the conflict began, the United Nations said on Friday.

The total includes 50,227 recorded in Turkey, where more than 6,000 Syrians arrived this week alone, it said.

"There certainly in the past week has been a sharp increase in the numbers arriving in Turkey, and there many of the people are coming from Aleppo and surrounding villages," Adrian Edwards, spokesman of the U.N. High Commissioner for Refugees (UNHCR), told a news briefing.

"Now if you look at other areas, I think that the situation is more of a steady and continued increase, but where fighting happens we tend to see the consequences," he said.

Syrian forces have pushed rebels back from a strategic district of Aleppo, but skirmishes continued and the United Nations said the conflict engulfing Syria would have no winner.

As of Thursday night, there were 45,869 Syrian refugees registered in Jordan, 36,841 in Lebanon and 13,730 in Iraq - which has also seen the return of 23,228 Iraqis from Syria since July 18, according to the Geneva-based agency.

"In several countries we know there to be substantial refugee numbers who have not yet registered," Edwards said.

Some Syrian refugees have also turned up in other countries including Algeria, Egypt and Morocco, and Evros, the Greek region that borders Turkey, he said, adding that the numbers were "really tiny" compared to the flows to Syria's neighbors.

(This story corrects official UNHCR figure for refugees in Iraq to 13,730 from 13,587)

New photos of iPhone 5 parts emerge as release nears

While we may have already seen the external pieces of?the next-generation iPhone fully assembled, new purported images of parts from?the upcoming smartphone reveal some new information. Along with showing the nano-SIM tray, home button and internal sensors, the alleged images, which were published by French blog Nowhereelse.fr and discovered on a now defunct Chinese forum, also reveal a metal backing that is said to sit behind the handset?s display. It is unclear what the protective element?s exact purpose is, however some have speculated that it may be an electromagnetic shield or a piece to separate the iPhone?s screen from hot internal components. Apple?s?(AAPL) iPhone is rumored to be equipped with 1GB of RAM, NFC and 4G LTE connectivity, and the Cupertino-based company is expected to unveil the device on September 12th.

Ryan Lochte, Michael Phelps to Go Dancing With the Stars?

The London Olympics are almost over, but will we see swimming studs Ryan Lochte and Michael Phelps square off on Dancing With the Stars next?

A newly-retired Phelps said earlier in the week that he wouldn't rule out following in the footsteps of Olympians who have gone on the ABC show.

He'd probably do well, but if it's up to his teammate and friendly rival Lochte, he'd best prepare himself for some stiff competition on the parquet.

Michael Phelps, Ryan Lochte

"Since I'm so used to competing against Michael Phelps, I'd go on [Dancing with the Stars] with him," said Lochte, who won five medals in 2012.

"I could do Dancing with the Stars! Yeah, I think so."

No doubt Ryan Lochte's sister and mom in the audience cheering him on alongside Michael Phelps' mom in what would be a rematch for the ages.

Or at least reality TV. Who'd you rather see on DWTS?

Debt Management vs. Debt Consolidation ? What's the Difference ...

Debt Management vs. Debt Consolidation What?s the DifferenceIf you find yourself in a difficult financial situation, and you?ve unsuccessfully tried to work through the issues completely on your own, then you may start looking for help. Two possibilities you?re likely to hear our debt management and debt consolidation.

If you?ve never heard of either one of these before, or if you?re not exactly sure what they mean, the differences between the two services can sometimes be a bit confusing. However, the two services are different enough that it?s important to know which one might be more appropriate for you, and under what circumstances.

Here?s a brief discussion of the differences between debt management and debt consolidation.

  • Debt Management Overview. Debt management (also sometimes referred to as ?debt settlement?) is a process whereby you first meet with a debt counselor, either in person or over the telephone, and they interview you extensively about your current financial situation. Based on the information you provide, a debt management service will contact your creditors and attempt to negotiate lower interest rates or lower monthly payments ? either on a short-term basis or a permanent basis.
  • Debt Consolidation Overview. Debt consolidation generally involves taking out a single new loan to pay off multiple loans, credit cards and lines of credit. The new loan generally has a lower interest rate or a longer repayment term, or both, than the average of all of the other debts that are being paid off. As a result, the net effect is a lower monthly payment.
  • Fees. A debt management firm will charge fees that are often due on a monthly basis, and are generally computed on the basis of the amount you owe (or sometimes the amount by which your total monthly payments have been lowered). Over time these fees can add up, although many individuals in financial distress find that they pay less in fees than they end up saving with the reworked debt obligations. For a debt consolidation you?re only likely to pay an additional fee when the new line of credit is opened. You?ll still be responsible for the monthly interest charges, of course, but these are likely to be lower than what you were already paying.
  • Credit Rating. In most cases, a debt management service is only able to negotiate lower payments after you?ve been late on at least one of your loans or credit cards. Your lender or credit card company generally won?t be likely to work with a debt management consultant if you?re still paying your bills on time, since there?s little incentive to do so? This means that you can usually only get maximum benefit from a debt management service once your credit report and credit rating have already suffered.
  • Planning and Advice. Debt management services will also provide you with ongoing planning and financial advice, to make it less likely that you?ll find yourself in a bad financial situation in the future. Debt consolidation services generally do not include this feature.
  • Before you give serious consideration to using the services of either a debt management or debt consolidation firm, make sure you understand exactly what you?re getting for the fees you?ll have to pay.

Your Guide to Health and Safety Consultants | Business Finance ...

Health and safety in the workplace is something that is very important. Many companies will opt for hiring health and safety consultants to ensure that the health and safety of their employees is a top priority. There are a lot of cases of accidents happening in the workplace, but with a health and safety team you can really cut down on these instances. It can be considered a very wise business investment. Here you will find some of the benefits.

One huge advantage is the fact that it can improve the morale of the workers of your company. It can help them to feel safer while they are at work, which will help them to feel better about their job. If they are happy and safe while they are at work, they will also be able to perform their tasks better. They will usually also be more loyal to the company, reducing your turnover as a result- which is a big plus.

Next, you will see that hiring health and safety consultants can help to increase the productivity in your workplace. If there are not as many accidents at work, the employees are able to get a lot more work done. When the inevitable accident does occur, the recovery time is usually cut drastically when you have a health and safety team to turn to. When you increase your productivity at work, you also increase your profits- it?s really a win-win situation.

Another thing to consider is your risk of legal claims. When you don?t have a health and safety consultant on board, there will likely be more accidents in the workplace. Anytime there is an accident at work, you run the risk of being sued. If you have health and safety consultants on board, they will be able to help implement health and safety rules in the workplace which will cut your risk of having legal claims filed against you.

As you can see, there are quite a few benefits that come along with hiring health and safety consultants. You will also find that it is not really an added overhead expense, as it is really much more of an investment to your business. While it may cost more up front, you will soon find that you save a great deal of money in the long run. Make sure that you keep this in mind when looking for health and safety consultants.
